SUBDIVISION REVIEW PROCESS

The review process for all subdivision and land development applications in those municipalities with their own regulations in place will  follow the accompanying CHART.  The CHART, and this narrative, can be copied and provided to those interested in submitting an application  for  a subdivision or land development so that they are aware of the procedure. 

  1. All applications for a subdivision or land development shall be submitted to the local municipality (township, borough, city).
     
  1. The local municipality will review the application to determine whether all required information (application, plans, fees, reports, studies, etc.)  has been submitted.  The municipal review can be completed by the municipal secretary, planning commission chairman, zoning officer,  building inspector, etc.  This review person should be designated so that everyone knows who receives the application.
     
  1. The application must be reviewed to determine whether all required information has been submitted.  The municipal reviewer should  complete  a check-list of required information.

If all the required information has been submitted, the application can be accepted and placed on the agenda for the next municipal planning  commission meeting.  If all required information is not present, the application shall be returned to the applicant with a written explanation  as to why the application is being returned.

At this time, a copy of the complete application, including all plans, reports and studies, shall be submitted by the municipality to the  Lawrence County Planning Commission (LCPC) and any other agency (including the municipal engineer) that the municipality determines  should review the application material.

The LCPC and additional review agencies shall complete their review and submit all comments to the municipal planning commission.  No  decision by the governing body shall be made until the LCPC has responded, or 30 days has passed from the date of  submission to the LCPC. 

  1. The municipal planning commission reviews the application at its next regularly-scheduled meeting.  The 90-day review time period begins at  this meeting.  LCPC comments and other review agency comments may be available for this meeting.
     
  1. The municipal planning commission makes a recommendation to the governing body and may sign the mylar. The governing body reviews  the recommendation of the municipal planning commission and any other review agencies and makes a decision within the 90-day review  period.  The governing body shall not act on an application prior to receiving a response from the LCPC, or the passage of  30 days

The decision of the governing body must be communicated to the applicant, in writing, within 15 days of the decision.

If a plan is denied, the governing body must identify the defects of the plan; the standards in the ordinance; and the specific sections of the  ordinance that are not met. 

  1. Upon approval of an application by the governing body, the mylar print of the plan can be signed.  The mylar should then be submitted to the   LCPC for their signature and then to the Recorder’s Office for recording.  The mylar must be recorded within 90 days from the date of  approval by the municipality.  A copy of the recorded plan should then be returned to the municipality.

If an application is given a conditional approval, the mylar shall not be signed by the governing body until the conditions have been met.  At  this point, the mylar can then be submitted to the County for signatures and recording.
